This Website Privacy Policy applies to the http://cendynovations.com website (the “Site”), which is owned and operated by Cendyn Ovations, LLC (“Cendyn”, “We”, “Us”).  This Policy describes how we collect, use, share, and secure personal information you provide as well as your choices regarding use, access, and correction of your personal information.

Collection of Information

Cendyn Ovations collects personal information that you provide to us. The term “personal information” refers to data you voluntarily provide in connection with use of the Site that identifies you and/or the company on whose behalf you are accessing and using the Site. Personal information includes your name, e-mail address, phone number, company affiliation, physical address and/or certain other personal information. In addition, you can sign up to receive Cendyn Ovation’s newsletter. To do so, we ask for your name and contact information.

Cendyn Ovations also receives other types of personal information from your use of our Site. The term “Passively-collected Personal Data” refers to general information regarding visitors and users of the Site that relates to use of the Site, e.g., Internet Protocol (IP) addresses, Internet Service Provider (ISP), browser type, traffic patterns, number of visits to certain pages, visits from other web sites or to third-party web sites linked to the Site, use of particular services and interest in services, information or features of the Site or of other parties made available through or found at the Site.

Cendyn Ovations receives information from other sources. We may receive information about you (such as household income) from other sources, including publicly available databases or third parties from whom we have purchased data. We combine this data with information we already have about you to help us to update, expand and analyze our records, identify new customers, and provide products and services that may be of interest to you.

 

Use of Information

We use the personal information you provide to meet our contractual obligations in, for example, fulfilling your order(s) or sending you updates on your order or purchases. We also use personal information for our legitimate business interests in engaging with our customers and improving our products and services. For residents of Canada, we collect, use and disclose your personal information in accordance with the Personal Information Protection and Electronics Document Act (“PIPEDA”).

Cendyn Ovations is interested in improving the Site and may develop and offer new features and services. We monitor Passively-collected Personal Data regarding use of the Site for marketing purposes and to study, improve and promote use of the Site. In connection with such purposes, Cendyn Ovations may share Passively-collected Personal Data with third parties collectively and in an anonymous way (“Aggregated Data”).

 

Access and Choice

You may opt-out of receiving communications from us at any time by clicking the button to unsubscribe in a communication. Please note that the information on our marketing lists is only used for Cendyn Ovations purposes or in joint promotions with a Cendyn Ovations partner. We do not sell, rent or share any of your personal information with any other party, nor use it for unapproved commercial purposes.

If you reside in the European Union, you have particular rights available to you depending on the legal basis for processing. When we process data you provide to us as necessary to perform our contracts with you, you have the right to data portability. When we process data you provide to us based on your consent, you have the right to withdraw your consent at any time and to data portability. When we process your data based on our legitimate interests, you have the right to object to, and seek restriction of, such processing. To exercise your rights, please contact us using the contact information provided at the end of this policy. You also have the right to lodge a complaint with your supervisory authority.

 

Retention of Information

We will retain your information for as long as your account is active or as needed to provide you services and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

 

Information Sharing

We will share your personal information with third parties only in the ways that are described in this privacy policy.

We may also provide your personal information to our third party service providers who provide services to help us with our business activities such as sending you emails or offering customer service. These companies are authorized to use your personal information only as necessary to provide these services to us.

In addition, Cendyn Ovations may disclose personal information: (1) when we believe in good faith that disclosure is required to protect the security, property, assets and/or rights of Cendyn Ovations from unauthorized use, or misuse, of the Site or anything found at the Site, protect your rights, protect the safety of others, investigate fraud, or respond to a government request; (2) when required by law, such as to comply with a subpoena, bankruptcy proceedings, or similar legal process; however, only to the extent necessary and in a manner that seeks to maintain the privacy of the individual; or (3) in the event of a liquidation, reorganization, merger, consolidation, change of control, asset or stock acquisition/disposition or other corporate combination.

 

Use of Tracking Technologies

Technologies such as cookies, beacons, scripts, tags, and other similar technologies are used by Cendyn Ovations and our marketing partners, affiliates or analytics or service providers such as Google™. These technologies are used in analyzing trends, administering the website, tracking users’ movements around the site, and gathering demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual and aggregated basis. Various browsers may offer their own management tools for removing these types of tracking technologies. Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. We do not currently respond to those signals.

To enable features at the Site, Cendyn Ovations may assign one or more “cookies” to your Internet browser. Cookies, among other things, speed navigation through our Site, keep track of information so that you do not have to re-enter it each time you visit our Site, and may provide you with customized content. A cookie is an internet mechanism composed of a small text file containing a unique identification number that permits a web server to send small pieces of information or text by means of your browser and place them on your computer’s hard drive for storage. As is true of most websites, we gather certain personal information automatically and store it in log files. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We do not link this automatically collected data to other information we collect about you.

We also partner with third parties to either display advertising on our website or to manage our advertising on other sites. Cendyn Ovations may provide links to a number of other web sites that we believe might offer you useful examples of our work and services. However, those sites may not follow the same privacy policies as Cendyn Ovations. Therefore, we are not responsible for the privacy policies or the actions of any third parties, including without limitation, any web site owners whose sites may be reached through this Site, nor can we control the activities of those web sites. If you submit personal information to any third party sites, your information is governed by the privacy policies of those third party sites. We urge you to contact the relevant parties controlling these sites or accessing their on-line policies for the relevant information about their data collection practices before submitting any personal information or other sensitive data.

 

Social Media Widgets

Our website includes social media features, such as the Facebook Like™ button, and widgets, such as the “Share this” button or interactive mini-programs that run on our website. These features may collect your Internet protocol address, which page you are visiting on our website, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our website. Your interactions with these features are governed by the privacy statement of the company providing it.

 

2. PRIVACY SHIELD FRAMEWORK

Cendyn Ovations participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework. Cendyn Ovations is committed to subjecting all personal information received from European Union (EU) member countries and Switzerland, respectively, in reliance on each Privacy Shield Framework, to the Framework’s applicable principles.  To learn more about the Privacy Shield Frameworks, and to view our certification, visit the U.S. Department of Commerce’s Privacy Shield List at https://www.privacyshield.gov/list. The following U.S. entities and subsidiaries also adhere to the Privacy Shield Principles:

Cendyn Ovations has further committed to cooperate with the EU data protection authorities (DPAs) for EU employees, and the Swiss Federal Data Protection and Information Commissioner for Swiss employees, with regard to unresolved Privacy Shield complaints concerning human resources data transferred from the EU or Switzerland, respectively, in the context of an employment relationship.

Cendyn Ovations is responsible for the processing of personal information it receives, under each Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. Cendyn Ovations complies with the Privacy Shield Principles for all onward transfers of personal information from the EU and Switzerland, including the onward transfer liability provisions.

With respect to personal information received or transferred pursuant to the Privacy Shield Frameworks, Cendyn is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Cendyn Ovations may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, please contact our U.S.-based third party dispute resolution provider (free of charge) at https://feedback-form.truste.com/watchdog/request. 3. DATA PROCESSING ON BEHALF OF OUR CLIENTS

Cendyn Ovations provides various online service tools to the ticket management and hospitality industries. These tools include CRM, Loyalty, eMail Marketing, Hotel RFP response, Digital Marketing, Web Design, Revenue Management, Online Menus, Strategic Meetings Management, Event Planning and Online Ticketing. Members of the industries that engage us to provide these online service tools are our “Clients”.

Cendyn Ovations collects and processes personal information at the direction of our Clients, and has no direct relationship with the individuals whose personal information it processes. In the course of using the online service tools, our Clients’ users may provide personal information such as name, email and phone number, which we will store on behalf of our Clients. The use of information collected on behalf of our Clients shall be limited to the purpose of providing the service for which our Client has engaged us. We may supplement the information that Clients provide to us with aggregated consumer data (such as gender, postal address, geographic location, marital status, and amounts spent on leisure and travel activities). In addition, in order to provide services to our Clients, we may be required to transfer personal information to third-party companies that help us provide that service. Any such transfers to those third parties are covered by our service agreements with our Clients.

If you are a customer of one of our Clients and would no longer like to be contacted by them through our online service tools, please contact the Client that you interact with directly. Cendyn Ovations acknowledges that you have the right to access your personal information. An individual who seeks access, or who seeks to correct, amend, or delete data should direct this query to the Client that you interact with directly (the data controller). Cendyn Ovations will respond to a request from a Client to remove an individual’s data within a reasonable timeframe.

We will retain personal information we process on behalf of our Clients for as long as needed to provide services to our Client and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

California Consumer Rights

If you are a resident of California, you have the following rights:

  • Right to Know. You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:
    • The categories of personal information we collected about you.
    • The categories of sources for the personal information we collected about you.
    • Our business and commercial purpose for collecting or selling that personal information.
    • The categories of third parties with whom we share that personal information.
    • The specific pieces of personal information we collected about you.

    at /privacy_rights_request_form/. To verify your identity, we may ask you for additional information, which may include asking you to confirm other personal information you have provided to us. We reserve the right to deny any requests for which identity cannot be verified. If you have authorized another person to make a request on your behalf, that person must provide to us your written authorization allowing them to make such a request on your behalf. We reserve the right to deny any request by an authorized agent if we are not reasonably able to confirm proper authorization.
  • We will not discriminate against you for exercising any of your rights under California law. Unless permitted by California law, we will not:
    • Deny you goods or services;
    • Charge you a different price or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
